Following on from the mandatory data protection officer (DPO) appointment requirement introduced by the Personal Data Protection (Amendment) Act 2024 and the circular and guidelines on the Appointment of DPO published by the Personal Data Protection Commissioner (“Commissioner“) (“DPO Guideline“) (covered in our previous client alert), the Commissioner had recently issued three new documents, namely the:
- DPO Competency Guideline
- Management of DPO Training Service Providers Guideline
- DPO Professional Development Pathway & Training Roadmap
Such guidelines and roadmap offer further clarification of what is expected of a DPO and lay down a more structured approach to DPO competency, training, and training provider recognition. Data controllers and data processors are therefore advised to take these into account when appointing a DPO or ensure that their appointed DPO meets such expectations.
